Exempt Employees (not overtime eligible) have flexibility when it comes to creating a Compressed work schedule. Non-exempt Employees (overtime eligible) have to keep in mind that they incur overtime in any week in which they work more than 40 hours.

Scenario 1 —Permits the exempt employee to have one non-work day every two weeks

Week 1:  Work five 9-hour days (45 hours total)
Week 2:  Work three 9-hour days and one 8-hour day (35 hours)

To not incur overtime, a non-exempt employee might work:

Scenario 1A

Week 1:  Work four 10-hour days with 1 non-work day
Week 2:  Work five 8-hour days

Scenario 2 — Permits the exempt employee to have one non-work day per month

Week 1-2:  Work five 8-hour days
Week 3:  Work four 9-hour days and one 8-hour day
Week 4:  Work four 9-hour days

To not incur overtime, a non-exempt employee might work:

Scenario 2A

Weeks 1-3:  Work five 8-hour days
Week 4:  Work four 10-hour days

Scenario 3 — Permits the exempt or non-exempt employee to have one non-work day per week

Weeks 1-4: Work four 10-hour days

*It is mandatory for any employee who works more than 6 hours per day to have a ½ hour unpaid lunch break which must be in addition to the hours worked.
